What is a Data Use Agreement (DUA)?

A Data Use Agreement (DUA) is a required legal agreement. It allows data to be shared between LSUHS and an external institution or party while ensuring the data is protected under HIPAA and LSUHS policies.

A DUA explains:

  • What data is being shared
  • How the data can be used
  • Who can use or receive the data
  • How privacy and legal protections will be ensured

What is the Role of the Office for Innovation & Commercialization (OIC)?

OIC helps faculty and researchers with all incoming and outgoing DUAs.

  • Coordinates and tracks DUA requests
  • Assesses intellectual property (IP) considerations
  • Ensures necessary compliance reviews (e.g. HIPAA, Privacy)
  • Routes agreements for legal review and signature
  • Maintains records of DUAs for institutional tracking

    

To begin, fill out a DUA Transfer Initiation Form

Incoming Data Use Agreement Form  Outgoing Data Use Agreement Form

You must complete this form for any data shared with or received from an external party, even if the other institution says a DUA is not required. This ensures LSUHS reviews data sharing for compliance, legal, privacy, and IP considerations.

Data sharing agreements can only be signed by official institutional signatories or administrators authorized by LSUHS. Researchers and staff are not permitted to sign agreements on behalf of the institution.
